Consent to Terms

Please read these Terms of Use before using The Talent Book or any features of this site (collectively, the "The Talent Book Website" or "Service"). By using the Service, you agree to be bound by these terms of use. If you do not agree to these terms of use, please exit the Service. We reserve the right, at our sole discretion, to modify, add or delete portions of these terms at any time by posting updated terms of use on the The Talent Book Website. Please check these terms frequently for updates. Any modifications, additions or deletions to these terms shall be effective immediately upon posting of updated terms of use. Your continued use of the Service following the posting of updated terms of use shall mean that you agree to those changes.
I represent that I am 18 years of age or older, or that I am the legal parent, or guardian of any person under the age of 18 wishing to register for or use this service.
I understand that a registration is not considered complete until I have made payment in full. I understand that registrations require the signature of the registrant, and/or the credit card holder, and/or the parent or guardian. I understand that there are no full, or partial refunds of any workshop, seminar, special event, or service fee after the workshop/seminar/service/special event has begun. I may withdraw with a refund at any time prior to the first day of the workshop/seminar/service/special event. I understand that if I elect to withdraw prior to the date of the workshop/seminar/service or special event, that The Talent Book may at it's election, withhold $35 for administrative expenses. I understand that any refund under the terms of this agreement will be made in the form of a credit to the credit card I used to make payment, or by a company check if paid by cash or by my personal check. I understand that the refund process may take up to 30 days to complete.
I understand that guarantees of employment are neither expressed nor implied. Individual results will vary depending on my education, drive, ambition, ability and determination. I understand should employment result from attendance at any of The Talent Book programs or services, that I alone will be responsible for any and all state, federal or local taxes unless provided explicitly by the prospective employer, and that any applicable performance union fees will be my sole responsibility.

Products & Services

All manufacturers warranties apply as outlined in the product literature provided by the manufacturer. The Talent Book does not represent the manufacturer, and therefore does not itself honor product warranties. I understand that any warranty issues are the sole responsibility of the manufacturer of the product. I understand that products damaged in shipping are insured through United Parcel Service, The US Postal Service, or a special carrier designated prior to shipping to my address. I understand that any claims of product damage must be reported to the company that delivers the product to my home. While The Talent Book may at it's election assist me in any claim, they are not obligated to do so. I understand that I may return an unopened item in its original packaging within ten days of receipt. I understand that all product and service sales from The Talent Book are final unless otherwise specified.

Credit Cards

By sending this registration, I agree to allow The Talent Book and/or its designee to charge my credit card account under the above terms & conditions, and the terms of my credit card agreement with my credit card issuer.

Checks

I agree that if The Talent Book accepts my personal check, that my registration will not be considered valid until such time as the funds clear my bank. I further agree that should the check be returned for insufficient funds, or for any other reason, that The Talent Book may redeposit the check, and charge my account via ACH transfer for an additional $39.00 returned check fee. I agree that this fee will be in addition to any fees my bank may assess my account.

The Talent Book maintains this site (the "Site") for your personal entertainment, information, education, and communication. Your access to and use of the Site is subject to the following terms of use (the "Terms") and all applicable laws. By accessing and browsing the Site, you accept, without limitation or qualification, the Terms and acknowledge that any other agreements between you and The Talent Book regarding the subject matter hereof are superseded and of no force or effect.

You may download one copy of material displayed on the Site for non-commercial, personal use only, provided you also retain all copyright and other proprietary notices contained on the materials. You may not, however, distribute, publicly display, modify, transmit, reuse, repost, or use for public or commercial purposes the content of the Site, including the text, images, audio, and video without The Talent Book's prior written permission.
You should assume that everything you see or read on the Site is copyrighted (unless otherwise noted) and may not be used, except as provided in these Terms or in the text on the Site, without the prior written permission of The Talent Book. The Talent Book neither warrants nor represents that your use of materials displayed on the Site will not infringe the rights of third parties not owned by or affiliated with The Talent Book.

The Talent Book makes no warranties or representations as to the accuracy or completeness of the information in the Site. The Talent Book assumes no liability or responsibility for any errors or omissions in the content of the Site. The information in the Site may be out of date, and The Talent Book makes no commitment to update such information. Documents and other information available on the Site may be subject to further disclaimers contained therein as to their accuracy and reliability.

Your use of and browsing in the Site are at your risk. Under no circumstances, including but not limited to negligence, shall The Talent Book or any other party involved in creating, producing, or delivering the Site be liable for any damages whatsoever (including, without limitation, any direct, incidental, consequential, indirect, or punitive damages) arising out of your access to, use of, or inability to access or use the Site, even if The Talent Book or a Talent Book authorized representative has been advised of the possibility of such damages. Without limiting the foregoing, everything on the Site is provided to you "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT. Please note that some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. Check your local laws for any restrictions or limitations regarding the exclusion of implied warranties. The Talent Book also assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing in the Site or your downloading of any materials, data, text, images, video, or audio from the Site. Your sole remedy for dissatisfaction with, or damage sustained from the Site is to stop using the Site.

Any communication or material you transmit to the Site by electronic mail or otherwise, including any data, questions, comments, suggestions, or the like are, and will be treated as, non-confidential and non-proprietary. Anything you transmit or post may be used by The Talent Book or its affiliates for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting. Furthermore, The Talent Book is free to use any ideas, concepts, know-how, or techniques contained in any communication you send to the Site for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products using such information.

Images of people or places displayed on the Site are either the property of, or used with permission by, The Talent Book The use of these images by you, or anyone else authorized by you, is prohibited unless specifically permitted by these Terms, or specific permission provided elsewhere on the Site. Any unauthorized use of the images may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes.

The trademarks, logos, and service marks (collectively the "Trademarks") displayed on the Site are registered and unregistered Trademarks of The Talent Book and others. Nothing contained on the Site should be construed as granting, by implication, estoppels, or otherwise, any license or right to use any Trademark displayed on the Site without the written permission of The Talent Book or such third party that may own the Trademarks displayed on the Site. Your misuse of the Trademarks displayed on the Site, or any other content on the Site, except as provided in these Terms, is strictly prohibited. You are also advised that The Talent Book will aggressively enforce its intellectual property rights to the fullest extent of the law, including the seeking of criminal prosecution.

The Talent Book has not reviewed all of the sites linked to the Site and is not responsible for the content of any linked sites or any link contained in a linked site or any changes or updates to such sites (collectively, "Linked Sites"). The Talent Book does not endorse or make any representations regarding any Linked Sites. Your linking to any Linked Sites is at your own risk.

Although The Talent Book may from time to time monitor or review discussions, chats, postings, transmissions, bulletin boards, and the like on the Site, The Talent Book is under no obligation to do so and assumes no responsibility or liability arising from the content of any such locations nor for any error, infringement, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger, or inaccuracy contained in any information within such locations on the Site. You are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material, or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. The Talent Book will fully cooperate with any law enforcement authorities, or court order, requesting or directing The Talent Book to disclose the identity of anyone posting any such information or materials.

The Site is controlled and operated by The Talent Book from its offices within the Commonwealth of Massachusetts, United States of America. The Talent Book makes no representation that materials in the Site are appropriate for use in other locations. Those who choose to access the Site from other locations do so at their own risk and are responsible for compliance with any and all local laws, if and to the extent local laws are applicable. No software from the Site may be downloaded or otherwise exported or re-exported into (or to a national or resident of) any countries that are subject to U.S. export restrictions. By downloading or using software from this Site, you represent and warrant that you are not located in, under the control of, or a national or resident of any country that is subject to U.S. export restrictions.

The Talent Book may at any time revise these Terms without notice by updating this posting. You are bound by any such revisions, and should therefore periodically visit this page to review the then current Terms to which you are bound.

Your authorization to use the Site automatically terminates without notice if in The Talent Book's sole discretion you fail to comply with any of these Terms. Upon termination, you must immediately destroy any downloaded or printed materials.

This agreement is entered into in the Commonwealth of Massachusetts and shall be governed by and construed in accordance with the laws of the State of Massachusetts, without giving effect to any principles of conflicts of law. You hereby consent and submit to the personal jurisdiction of the state and federal courts located in Suffolk County, Massachusetts, for the purposes of litigating any action at law or in equity arising out of or relating to these Terms, and agree not to commence any such action against The Talent Book other than in such courts.

If any of the provisions of this agreement are held by a court or a tribunal of competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that this agreement shall otherwise remain in full force and effect. This agreement constitutes the entire agreement between the parties hereto relating to the subject matter herein.

The Talent Book does not allow framing of any part of its websites.

The Talent Book encourages, and permits links to content on The Talent Book Websites. However, the linking should not (a) suggest that The Talent Book promotes or endorses any third party's causes, ideas, websites, products, or services, or (b) use The Talent Book content for inappropriate commercial purposes. We reserve the right to withdraw permission for any link, at any time, for any reason.

The Talent Book may provide links to Internet sites maintained by third parties, over which The Talent Book has no input or control. The Talent Book does not endorse the content, operators, products or services of such sites, and The Talent Book is not responsible, nor liable for the content, operators, availability, accuracy, quality, advertising, products, services or other materials on or available from such sites. The Talent Book shall be in no way responsible or liable, directly or indirectly, for any damage or loss caused or alleged to have been caused by, or in connection with, use of or reliance on any such content, products or services available on or through such sites.

In the event a product or service available on or through the The Talent Book is listed at an incorrect fee, or with incorrect information, The Talent Book reserves the right to refuse or cancel any orders placed for the product or services listed at the incorrect fee. Your receipt of an electronic, or other form of order confirmation does not signify The Talent Book's acceptance of your order, nor does it constitute confirmation of The Talent Book's offer to sell. The Talent Book reserves the right at any time after receipt of your order to accept or decline your order for any reason. The Talent Book may charge and withhold any applicable sales tax for orders. You are solely responsible for all sales, use, or, or other taxes, on orders shipped to you, or services provided.
